The motion failed with a vote of 3 Ayes, 5 Noes - Brooks, De La Fuente, Kaplan, Nadel, Schaaf. Vice Mayor Nadel made a motion, seconded by Councilmember Schaaf to uphold the appeal and approve the application for a dog play area. The motion tied with a vote of 4 Ayes, 4 Noes - Brunner, Brooks, Kernighan, Reid. Pursuant to Rule 29 of Resolution 82580 C.M.S. Council's Rules of Procedure, this item will return to the next regularly scheduled City Council agenda to allow the mayor to cast the tie breaking vote.
